The Exercise Of The Right Of Condominium Ownership.

Giving a few typical cases of the treatment situation and combining the current legislation of our country, this article brings forward a number of issues at present about the condominium ownership system of our country and probes the problems on the content of condominium ownership, how to exercise and protect the right, the principles of the exercise of the right, and then puts forward the author's own proposal.The article consists of four parts.The first part is about the current situation of the exercise of the right of condominium ownership. Giving a few typical cases that reflect actual situation faced when the right is exercised, it analyzes the issues of condominium ownership system at present.The second part is about the content of condominium ownership and how to protect the right. Besides, it elaborates the protection system of the interests of condominium ownership that the author believes in, from the following means of self-protection aspects: the internal and external relations needed to be balanced by the right owner of condominium ownership, the liability of the infringer, co-management groups and litigation.And in the third part, it is introduced about the right owner of condominium ownership, and the limitation of the right which is grounded on a legal nexus related to condominium ownership. This section is mainly dedicated to be foundation of the next part which is about the principle of realizing one's right with reason.The values, the general and basic principles of the exercise of the right of condominium ownership are discussed in detail on the fourth part, and the author put forward the proposals prospects about legislation forecast of condominium ownership.
