Research On Community Correction System

With the idea of "socialization" and "the criminal human rights" putting forward, the proportion of the non-confinement penalty in the penalty execution system is bigger and bigger,so community correction(a new kind of criminal enforcement pattern),first introduced in the west,is that the criminals was executed the targeted management and education reform in the community by using the comprehensive and various social resources and return to society smoothly. The concept of community correction makes the punishment more positive, once formed,and becomes the world’s development trend and the trend of execution. Influenced by this trend, our country began community correction pilot work in 2003, at present, more than ninety percent of the city, county and township across the country had been developed the work of community correction. After 10 years of pilot work, through the actively explore and practice in concerned departments, we gradually formed a unique mode of community correction with local characteristics, but also appeared a lot of problems just as the social acceptability of community correction is not high, the social participation is not strong, correctional system is imperfect, imperfect correctional institutions, and the weak power of correct ranks and so on. The meeting of The 18 th Chinese communist party and the 4th plenary session of 18 th CPC Central Committee puts forward the new requirements for community correction work in the new period. Under the new situation, adhering to and improve the community correction system with Chinese characteristics and solving various problems existing in the practice, is the inevitable requirement of carrying out the criminal policy of tempering justice with mercy.Today, theory circles mostly discuss the meaning of community correction, characteristics,theoretical origin and practical value of theoretical content, while having little involvement in practical running effect, developing difficulties and direction of community correction.Community correction is not pure theory, so it needs further thinking in practice and improvement.The author works in the grass-roots judicial administration in L City,Shandong province.Since 2005 L city has had its the eight counties comprehensively implementing the jurisdictionof community correction,which develops well in an orderly way and obtains some result,while facing some problems. The author work based on the advantage, choose the whole L city community correction work practice as a case to study with an integrated use of survey research, statistical analysis, case analysis, comparative analysis and other research methods,from the perspective of empirical research on the subject of community correction.By researching more representative results of analysis of L city, it puts forward some rationalization suggestions for the improvement of the system of the current correction.This article is divided into five chapters. In the first chapter, the author introduced the research background, significance, status, ideas and methods of this topic.In the second chapter,the author analyzes the theory evolution of community correction, has an explanation of the definition and theoretical basis of community correction.From the germination, the pilot of the development of community correction work in our country, comprehensive experiment and comprehensive progressive of the four stages, this paper discusses the effect and significance of the work of community correction. In the third chapter, the author introduces the practical work of L city community correction from the basic situation, the working mechanism design,working methods, and summarizes three aspects to sketch the work mode of community correction of L city. In the fourth chapter, the author studies the L city community correction work in all kinds of problems, including uncompleted organization systems, less supporting system, lack of executive main body and fuzzy, poor department coordination,the rigid management mode,weak team construction,lack of fund and public participation and so on.These problems are not unique for L city,which have deep roots from the traditional socialist ideas, lack of related legal system of community correction and the lack of social support,safeguard measures, etc. In the last chapter, the author discusses the new situation to promote the path of the community correction.The analysis, in the new period, on the one hand, improves the legal system by improving the legislation of community correction, formulating unified community correction method, changing the execution concept, strengthening the criminal policy support. On the other hand we need to improve the organization system, and constantly improve the institution of community correction system, innovative management system of community correction, the correction of developing specialized team and social volunteers.In addition, the legal supervision should be optimized, namely, to establish a unified criminal execution supervision department and the legal supervision mechanism, and perfect the rigidity and dynamic supervision of community correction.
