On The Information Disclosure Of Procuratorate

The implementation of the Regulation(on trial) of the People’s Procuratorate Case Information Openness is a major breakthrough on information openness mechanism of the People’s Procuratorate. The openness scope expends to the case itself. In order to guarantee the judicial justice and improve credibility of the judiciary, the Decision of the Central Committee of the Communist Party of China on Major Issues Concerning Comprehensively Advancing rule of law adopted at the Fourth Plenary Session of the 18 th Communist Party of China Central Committee put forward to construct an open, dynamic, transparent and convenient judicial mechanism, which accelerates the process of the People’s Procuratorate Case Information Openness. This paper compares the procuratorate case information openness between America and China, and also investigates and surveys the situation of the people’s procuratorate case information openness since the Regulation(on trial) of the People’s Procuratorate Case Information Openness has been implemented. On the basis of analyzing the survey data and researching the previous academic achievements, I think that there are four major issues existed in the people’s procuratorate case information openness mechanism: the people’s procuratorate has a weak consciousness in disclosing the case information; there is problem in the construction of case information openness platform; there exists an improper relationship between the people’s procuratorate and the media in the disclosure of case information; there is an unsound supervision mechanism over the people’s procuratorate case information openness. In response to above issues, I put forward the following suggestions with summing up the previous views and learning foreign experience: the people’s procuratorate should build up the consciousness of case information openness; should improve the construction of the case information openness platform; should establish a sound and interactive relationship with the media; and should perfect the supervision mechanism over case information openness. The improvement of the people’s procuratorate case information openness system has a great significance in deepening the judicial reform, enhancing judicial credibility and building a socialist country ruled by law.
