The Research Of The People’s Mediation System In The New Situation

People’s mediation refers to the people’s mediators persuade and prompt two sides take the perspective-taking, understand each other, eventually they resolve the contradictions through coming to an agreement. People’s mediation has convenient,effective, flexible and low cost advantages, is widely used in social life, and can effectively eliminate the contradictions, make the social order stable.Current our country is in the period of rapidly developing of market economy,new social contradictions continuously emerging,which not only brought opportunities and vitality for the development of the society, also make the contradictions and disputes becoming more and more diversified and complicated.People’s mediation is facing all kinds of impacts and challenges under the new situation, falling into stagnation and dispute resolution on marginal predicament.Under the background of "new situation", this paper explores the change of people’s mediation system, makes contributes to improving the people’s mediation system.This article is divided into four parts:the first part introduces the general theory of people’s mediation system, contains its overview and historical development,formed a basic understanding of people’s mediation. The second part is based on the current legislation of the people’s mediation system, introduces the new situation and the social contradictions of new situation, compares the people’s mediation with other dispute resolution methods, sums up the current work of the people’s mediation under the new situation, finally through the typical cases to compare the people’s mediation of new situation with the traditional people’s mediation,to have a deeper understanding of people’s mediation’s future development trend. The third part analyzes and summarizes the challenges and difficulties of people’s mediation system in the new period. The fourth part puts forward legal suggestions and security measures on the basis of the problems existing in the people’s mediation system.
