A Study On The Connection Between Administrative Law Enforcement And Criminal Justice

Administrative law enforcement and criminal justice is the important way of rule of law, administrative law enforcement to strengthen administrative management, found in a timely and effective manner and governance that exist in the administrative illegal behavior, achieve the goal of improving administrative efficiency; Criminal justice is through the prevention and punishment of the crime, to guarantee citizens’ legitimate rights and interests, achieve the goal of judicial fairness. Administrative law enforcement and criminal justice at the same time the fight against illegal activities, to maintain the rule of law, but also be able to restrict each other and promote common play its due role.However, in terms of the actual administrative law enforcement, administrative law enforcement and criminal justice has been unable to link up well, especially tend to exist in the actual administrative law enforcement to generation of punishment, the phenomenon of guilty sympathetically, should need timely transferred to criminal judicial organs in accordance with the law case, did not timely transfer. Thus, this paper administrative enforcement and criminal justice issues for the study, the introduction of the basic theory foundation of the administrative law enforcement and criminal justice, based on the analysis focuses on law enforcement and criminal justice problems and learn from foreign law enforcement and Criminal Justice basis of experience on the proposed China’s administrative law enforcement and criminal justice strategies in order to more effectively achieve convergence of administrative law enforcement and criminal justice, improve the level of rule of law construction in our country.
