A Study On The Subject And Object Of Corruption

Corruption has always been the focus of people’s attention and embezzling is one of the most common crimes. What is heinous is that embezzling not only brings threat to the political stability and economic security of the country, but also can cause major losses of public property. China’s political and legal circles attach great importance to the prevention and punishment of such crimes, the legislative system has been relatively complete, the criminal law of our country, ninety-third, ninety-first,183rd,271st,287th,382nd,383rd,384th have made specific provisions.As a traditional crime in our criminal law, the crime of corruption has been discussed and studied by many scholars and has achieved great results. However, with the economic and social development and changes, some of the crime of corruption cases are more subtle, complex and increasingly difficult to handle. In the judicial practice, there are still differences and disputes such as the convicting of the subject and the object range of corruption, etc.In this paper, the law, the relevant theories and difficult issues will be deeply studied through empirical and comparative analysis, basing on the results of theoretical research and the actual situations. The paper is mainly divided into three parts:the first part is an overview of the status quo and characteristics of corruption crime. Through the comparison of historical data and the relevant provisions of the criminal law amendment nine, the general situation of corruption crime is introduced. The second part discusses convicting the subject of the crime of corruption though actual cases. The third part is the research on the object of the crime of corruption, and several special cases are discussed.
