A Study On The Functional Orientation Of Industrial And Commercial Administration In The New Commercial Registration System

Commercial Registration System is very important in the process of public management of our government. It is an effective state means of management, regulation and intervention in the social affairs. In the process of social economic development, the Commercial Registration System plays a very important role in cultivating market players, maintaining market order and ensuring the security of market transactions. With the reform of our social economic system, the past commercial registration and approval system with the character of’strict approval-loose management’ is no longer adaptable to the new situation of economic development. In 2014 started a new round of economic reform in our country, which brought forth the rapid growth of market players and much more issues in imposing regulation. But as the main body of Commercial Registration System, the management concept and the regulatory methods of the Commercial Administrative Management Department have not been fundamentally changed. They cannot meet the new requirements of the Industrial and Commercial Institution and restrict its effective function. Under the background of the reform of Commercial Registration System, how Commercial Administrative Management Department accurately re-orientates its function, straightens out the relationships with other governmental institutions and makes full use of its duty have become the key problems to implement the commercial registration system. It is also the decisive factor that determines whether the Commercial Administrative Management Department can serve the economic and social development better after the reform of the Commercial Registration System,In the background of the reform of Commercial Registration System, this thesis will analyze the function of the Commercial Administrative Management Department before and after the reform of Commercial Registration System, based on literature analysis, case study and comparative analysis. With the New Public Service Theory and Limited Government Theory as the guide, it will try to re-orientate the functional positioning standards of the Commercial Administrative Management Department in the new system. Starting from the theory and legislation, subjective and objective aspects, it will analyze problems and reasons existing in the Commercial Administrative Management Department function orientation. Aiming at these problems, from the point of view of the practicability, it will put forward some proposals, such as changing the ideas, formulating uniform commercial registration laws, promoting the access convenience for examination and approval, improving credit information publicity system, clearing functional departments responsibility boundary, building "multi-dimensional" collaborative regulatory structure, strengthening the construction of industry associations, and realizing the new function of the Commercial Administrative Management Department in the Commercial Registration System Reform.
