The Real Estate Investment Trusts (REITs), a real estate securitization that makes a way to attract a large number of investors. Because of the flexibility and the high rate of return on investment, REITs has gradually become a significant financing tool. Comparing with some developed countries and regions, Chinese REITs has developed rapidly even its history is not really long. However, one of the most obviously disadvantage is unpredictable risk, and the recent situation shows the investor may face a high risk with legal standards.The purpose of this article is to evaluate the legal risk of the REITs, by means of evaluation analysis in mainly three aspects, including comparative analysis normative analysis and case study, combining with real practice in Chinese economy environment. Meanwhile, analyze and research the foreign REITs example to provide effective, reasonable and worth referenced methods or control experience also from the special legislation, property registration system, risk prevention mechanism and other aspects of the real estate trust fund to meet the status of the development of the law of risk prevention recommendations.
