On The Dispute Of Land Right In Inner Mongolia Pastoral Area And Its Solution

This paper mainly studies the disputes that impacts or affected by the land Ownership Determination of the pastoral in Inner Mongolia, involving rural farmland, grassland and pastoral areas, mountainous forest land ownership, tenure and related income.This paper discussed several typical situations of the land Ownership Determination disputes and its dispute settlement mechanism on the basis of analyzing the background and reasons for the land Ownership Determination disputes in Minority Area, combined with the actual situation in pastoral areas of Inner Mongolia, drawing rural areas dispute settlement mechanism, and put forward some views and suggestions to perfect the dispute solutions of land Ownership Determination in agricultural and pastoral areas,the "Land" stated in the paper mainly refers broadly agriculture agricultural land resources, including the farming land and grassland pastures in rural areas.This article contains the following four parts:The first chapter mainly summarizes the background and reasons of minority areas rural land ownership disputes, for the background explaining from land system reforming and the policies that benefit agriculture and husbandry which the Party and the Country have implemented in recent years.Under the above background, due to the promotion of the unique value of the land itself and the additional value, land use of tradition Minority Areas does not adapt to the implementation of the land system, coupled with long-standing historical issues and organs in ownership registration work is not in place resulting in the number of agricultural and pastoral areas of land Ownership Determination disputes continue to rise.The second chapter mainly does more detailed analysis some types of disputes which Inner Mongolia appears more several, including illegal subcontracting disputes, basic grassland levy illegal occupancy disputes, parcel boundaries unclear disputes and adjacent infringement disputes and other existing and potential disputes type, these disputes were either will influence land ownership determination, either caused by land ownership determination.In nature, there are not only civil disputes, but also administrative disputes.The third chapter mainly analyzes the operation status and existing problems of the dispute settlement mechanism for this kind of dispute in Inner Mongolia.Each settlement mechanism has strengths and limitations in solving the land ownership determination disputes.The fourth chapter is to make a few suggestions for improving the above-mentioned problems in dispute resolution mechanism.
