The Legal Value Of The Dynamic Process Of Target Selection

The legal value is meant to satisfy the needs of subjects so as to gain their emphasis and expect laws to possess the most fundamental existing states,attributes and functions on the basis of people and law,that is,the relation between subjectfs and objects.The author is of the opinion that the due nature of the legal value indicates its goal significance.Its objectivity and subjectivity determines the historical nature,multiple nature,contlicting nature and alternatives of the legal value goal.Its dynamic movement demonstrates the process of choosing,establishing and achieving the conflicting legal value goal.The continuity of this process shows the functions of the legal value and reveals the legal movement and developmental trend.The value goal that the contemporary Chinese law wants to realize exists in many states,both mutually coordinating and conflicting,which are embodied in three pairs of contradictions: individual freedom and social harmony,stability and development,and fairness and efficiency.This paper takes the basic interests of the ordinary people as the starting point and ahe important idea of "Three Represents" as a criterion,makes a dynamic exploration of the legal value based on a clear understanding of its implications,conducts an analysis of the main legal goal in contemporary Chinese society in combination with China's actual situation,and strike a balance and make a choice so as to benefit the practice of building a law-governing socialist country with Chinese characteristics...
