Voluntary Surrender Of A Number Of Issues

The surrender system is an important finding system of penalty. It traces back a long time and has a mature theory, which play an important role in the pratice of judiciary . With the society development, the system has some problems needed to discuss and further research in theory and practice.This paper includes about 40,000 words and three chapters :Chapter one : describle simply the period of the system's development , and compare it with the foreign country's surrender system; describle generally the judicial meaning of surrender system.Chapter two : discuss the concept, essence and characters of the surrender system ; give the legislative suggestion that the surrender system need three conditions ; and give the legislative advices of adding frank surrender, the subtal division of the surrender, and clarifing the crime handled only with complaint etc.Chapter three: discuss the theory bases and the adoptive trend of value of the surrender system ; and the principle of combination of "must reduce a penalty" and "can reduce a penalty" toward the surrendering criminal response.
