There are many order confusion phenomenon in our market at the present, for example, the market is full of fake goods of inferior quality, the conduct of smuggling, cheating foreign exchange and evading taxes runs wild, the act of evading bank debts and violating financial and economic principles is serious. All of these not only affect the healthy operation of national economic and bring serious damage to the state's and people's interests, but also worsen the investment circumstance, reduce the social credit, corrupt the national reputation and the image of reform and open. Strengthening and standardization of the market economic order are of great importance to deepen reform, widen open, realize the national stability and meet the challenge of the WTO.Rectify the market economic order not only on the surface, but also at the root. It is one of the important tasks of our country "Tenth five years plan". Under lead of the State Council the work of strengthening market economic order spread away all over the nation from the April of this year and obtained preliminary achievement. But the market order is not been settled at the root and the act of order confusion is going to restore after rectifying. Because the suitable institution is of great importance to safeguard good order, so if we are going to rectify market order we should analyze reasons from the institution defect and establish the needed institution circumstance.The institution is divided into two forms: regular and irregular institutions. The first is formed through fixed procedures by the social and includes laws, regulations, contract and policy system; The second is formed unconsciously in the long term association of people and includes the value concepts, ethics standard, moral principles and customs. The two institutions are different in origin, change, nature and operational mechanism, but they safeguard the social and market order by regulating people's conduct and help each other.From the institution defect the causes of market order confusion can be reduced to two. The first, order confusion is affected by two factors: the institution defect andthe invalid government act. Having character of historical period, limited by the social, economic and cultural development level, the two factors can't be completely avoided. The second, order confusion is affected by special causes of our country, for example, incomplete transform from planned economy into market economy, delayed rule of laws construction and not match of moral construction. These factors can be eliminated by improving institution and strengthening the legal system, cultural construction. It is necessary to improve institution settlement from three aspects for providing suitable institution background, regulating market order and guaranteeing efficient operation of market system. The first, science define the government function, regulate the government action and eliminate the arbitrary factor. The second, strengthen the legal system construction, improving laws and regulations, strictly enforce the laws. The third, strengthen the moral construction, establish the moral rules on the demand of market economy, cultivate the idea of market economy."Confusion is origin of the world, order is dream of human", improving the market economy institution is a historical task, for which all nations of market economy is making great efforts. Rectifying the market order confusion of our country is a systematic project, which need coordinate of all parties. Choose this problem as my essay of Master's degree is to make contribution to the academic basic work in rectifying and improving the market orders.
