At This Stage Of Our Party And State Organs Of Power Relations To Explore

The problem of the relation between the CCP and the organ of state power is a sticking point in the reform of Chinese political system. How to deal with the relation will decide the success or failure of the reform in Chinese political and economic system, and will also affect the development of Chinese political democratization. Under the guidance of Marxist theory on the relation between party and state,the dissertation primarily discusses the problem of how to deal with the relation between the Party and the organ of state power on the premise of adhering to the leadership of the Party.The first part is an introduction. In this part, the author introduces the internal and overseas general study survey of the relation between the Party and the organ of state power, the realistic value and theoretic meaning of this paper. Simultaneously the author also introduces the research' s emphases and the train of thought.In the second part, the dissertation explains simply the development history of the relation between the Party and the organ of state power. And the author points out that we should resolv the problem of how to realize the leadership of the Party if we want to deal with rightly the relation between the Party and the People' s Congress.In the third part , the dissertation analyses the development goal of the relation between the Party and the People' s Congress. Generally speaking, the goal comprises three principles, namely the principle of adhering to the political leadership of the Party to the Congress, the principle of the Party' s obeying the constitution and the other laws, and the principle of disjoining the functions of the Party and that of the Congress. The principles are the rules that we should follow when we correctly deal with the relation between the Party and the Congress. And the principles are also the development goal of the relation.In the forth part, the dissertation discusses the problems of how to improve the leadership of the Party to the Congress , and how to systematize the democracy inside the Party. The key to the settlement of the relation between the Party and the Congress lies in improving the leadership of the Party. To improve the leadership, we should make the Party realizethrough the Congress its leadership to the state affairs. At the same time, we must strengthen the Party' s construction of democratic centralism so as to systematize the democracy inside the Party.In the fifth part, the dissertation explores the problem of how to strengthen the construction of the Congress, and how to enhance the supervision of the Congress to Party.To strengthen the construction of the Congress,we should advance the representatives' character through the measures of reforming the election system and enhancing the supervision to the representatives. Meanwhile we should gradually realize the system of full-time representatives by the way of reducing the representatives, enlarging the extent of direct election and establishing political service institutions. And we should strengthen continuously the reformation of the specialized committees in constitution , procedure and authority. Strengthening the construction of the Congress will improve the supervision function of the Congress to Party. To enhance the supervision, we should establish the censorship of violation of the constitution. At the same time,the Congress can consider constituting a law about the parties that regulates definitely the parties, particularly the ruling party' s organization, rights, lines of action and duties etc.In the sixth part, the dissertation primarily discusses the problem of how to realize the relation' s systematization and legalization. As for the problem, we should bring the relation between the Party and the Congress into the constitution, and regulate the relation in the other laws.
