But under the environment of cyber, the fact that the hardware and the software has the peril , the confusion between the cyber information and the natural of knowledge of productions , the deviation between the private law of copyright and the sharing spirit of cyberspace has destroyed the essential relation between the cyber information and the knowledge natural of the works. It was inevitable to bring the impingement to the copyright under the cyber space. Theoretically speaking, the cyber technology has produced the conflict about how to orientate the behavior of transmission the writings on the cyber space. It is ill-considered to describe the transmission as the issue whether from the angle of nomology or technology, in the meanwhile the active copyright law has some theatrical disfigurement .In the practice the cyber technology has led to the impingement to the author on the right of person and riches.Under the environment of cyber space ,Firstly, it is necessary to nail down the duty that the ISP should take on who has close relationship with the impingement, Secondly, the author can take three measures of administration , elisor, technology to protect self-profit. In order to protect the author's right well we should take positive measures to overcome the shortcoming in the three means. As the soul of the cyber technology, the IP protection of software tied in and distinguishes from the other objects that are under the protection of the copyright system. Several system of IP law has advantages and disadvantages respectively, the form of impingement in the cyberspace is abundant, and among which the pirate is the most furious which solicitate severe aftereffect, so the government , the software enterprise and the user should do what they can to protect the IP of software. From the altitude of the philosophy we can find the reciprocity relationship between technology and law, For the philosophy muddle in the technology system which has affected the developmentof the technology, and the ontological paradox restricted the progress of the technology, Facing this fact, we should take aspiring means to diminish the shortcoming in both system to realize the harmony progress. Only in this way can we spur the harmony development between the two system ,. accelerate the productive and realize the ultimate solicitude for human beings.
