Privacy Jurisprudence

With the development of economy and technology, peoples think more and more of the right to privacy. It is helpful to study the internal logic of the tort and the protection of the right to privacy from multi- view angles by the economic analysis,the culture of the law and the philosophy of the law. From the viewpoint of economy, First, we analyze the economic base of the system of the right to privacy; Second, we use the theory of cost and benefit to study the tort and protection of the right to privacy. At last, Game theory is used in the study. Chinese privacy culture is deferent from the western in the developmental way, but the same as the western in the origin. Ancient Chinese lived in the tradition of protecting elders' privacy. And then we forecast the trend of the right to privacy in China in the present day. The choice theory and the interest theory are used to analyze and compare the source of the right to privacy. Existentialism help us to see clearly the ultimate aim of study. On the basis of all above, the principles and the ways and means of the damage of the right to privacy are advised, accompanied with legislation advices.
