Reeducation Through Labor System Is Reviewed

This part consists of five points: there is no way to determine the real nature of the labor reeducation system; the criterion of this system's definition and applying object is not definite and predictable; its examination and approval authority exists in name only; its severity degree doesn't correspond to its harmfulness to the society; it is quite deficient in its application procedures.Part Two: the reformation scheme of the present reeducation system and its reflection. This part has three points. In the first point, it analyzes the reasons of "existence theory" and the basic contents of the four typical reformative plans; in the second point, it expounds the reasons of "abolition theory"; in the third point, it shows that the author is in favor of the "abolition theory" through evaluating the two above theories.Part Three: the solution of the present reeducation system.This is the main part of the essay. It breaks down the four applying objects of this system. This part comprises four parts: treatment for the smalldelinquency offenders who are inadequate for criminal punishment; How to treat the severe delinquents who break the law of public security; how to punish the security breakers who refuse to mend their ways despite of repeated admonition; how to deal with the offenders whose cases are not severe enough to be brought to the court by the procuratorate.
