Discussion Of Response After The Abolition Of The System Of Reeducation Through Labor

As a special system in China, The System of Reeducation Through Labor has implemented for nearly 60 years,and finally be abolished. However, because of its long-term influence and special status in China’s legal system, repeal does not mean once and for all,and the remaining issues still need to be resolved. There are some research discussion and plans about the path choice after the abolition of the system of reeducation through labor both theoretically and practically.On the basis of researching and expounding the influence of abolishing the system of reeducation through labor, this paper will analyze some of these schemes or views, during which process this thesis will make the related thinking and put forward its own proposals.Specifically, the main body part of the paper is divided into three parts to build:The first part:first of all, considering the fact that the System of Reeducation Through Labor is already abolished, this paper summarizes the meaning of ending this system which has been bombed with criticism. Then, from the perspective of the System of Reeducation Through Labor’s functions and benefits, this paper also analyzes some practical problems after its abolition.The second part:with the discussing and starting from the realities of the rule of law in our country, several kinds of main viewpoints about the countermeasures will be introduced after the abolition of The System of Reeducation Through Labor. The paper will respectively discuss the schemes such as the revision of criminal law, division processing of those original people who should receiving the reeducation, setting up the security measures system,replace by community correction, and then concluded that the above several ways are not conform to the reality and requirement of our country after a comprehensive consideration.The third part:starting from the reality, The illegal behavior education correction law is put forward. Beginning with the study of the legislation necessity, the paper will give its own suggestion about the several aspects that legislation should make clear, the key pints of which include the nature, principles, the applicable objects and scope as well as the decision and implementation process of the law.
