Administrative Law Theory Based On National / Social Horizon

In this article, the author tries to discuss the basic problems of department law from the viewpoint of sociology, politics and jurisprudence, with the basic theory of administrative law as the startpoint and final settling place. This study is placed in the wide visual threshold of constitutionalism and conflicts between state and society .The author tries to gain the new access to the study , to get through the original acdemic idea. The main discoveries are as the follows. First , the origin, development, formal evolution and improvement of administrative law and this basic theory are rooted in the course of state-society and the relation between state and society is embodied by the relation between the administrative affairs and relative person, the basic relation in administrative law. Second, the essence of relation between state and society in globalization era can be described as "Four-dimension-and-Eight-stratum" phenomenon, which is doomed to the revolutionary change of administrative law and its basic theory. Third, the long-standing disputes on the basic theory of administrative law in globalization era proves to be the theory of "good governance" based on the relationship of "Four-diminsion-and-eight-stratum".
