Study Of China's Land Requisition System

Land system is a combination of land relationship under certain social condition. As a component of superstructure, it is one of the most important system which reflects the economic relationship among peoples. Land system in a certain period of time is closely connected with the social and economic style in the same period. In the same way, the different period of prolificacy development also calls for suitable land system. The core of land system is land ownership. It'sreflection is land ownership in law, which is a kind of proprietary right owned by land owner and protectedby stste law. According to the Consititution of People's Republic of China, the style of land ownership in China is divided into peasants collectivism land ownership and town state land ownership. The tate can change collective land ownership into sate land ownership by expropriation. It is a one-way flowage, and is the only style of land ownership flowage.Although there are a lot of land in our country, there are less plowland for a large amount of population. The average plowland area is just one fourth of world average level. The problem of land is not only connecting with the benefit of peasants, but also the healthy and steady development of economy and society, the existence and development of Chinese nationality. Land expropriation is on behalf of national economic construction and peasants' benefit. Some new problems and circumstances rise in land expropriation,which are more and more focused and reflected by society strongly.The present land expropriation system has some problems during practice like compensation standard is not reasonable, people settlement method during land expropriation is simple and building and other things on land compensation can not reach accordance and also has a lot of authorization procedures.There are some problems existed during land expropriation. We find tow reasons:in on hand those land management laws and re gulations h ave n ot b een fi nalized. T here i s s ome weak point in land expropriation; in another hand, there is some incomplete point in present land expropriation system, which is the fundamental problem.The land expropriation system is formed during planning economy period, which is not suitable for development of socialist marketing economy. So the reform of land expropriation is necessary.During the reform of land expropriation system, we should take several principles:to protect farm land and also guarantee economy construction land;to manage the peasants collection and farms behavior of land expropriation area; to attract the system of marketing economy and make land resources collection reasonably and also to take the principle ofequity,openness,and high-efficiency. To execute land usage general planning strictly,guarantee the quality of farm land, ascertain land expropriation compensation standard, take all kinds of resetting work after land expropriation, complete authorization system, make jural work more healthy, strengthen the work of legal propaganda and political and conceptional education, promote the social economy construction and to develop healthy, fast and completely.
