Western Development Center Co-ordination Of The Rule Of Law Study

Since central government decided to perform the strategy of west development, scholars all appeal to create good circumstances of rule by law, which can promote and guarantee the development of the west economy. As far as rule by law is concerned, few scholars discuss its coordination, while it is an essential sector. Because if we want the law system regulating west development to give full play to its function, the law system must be intact and harmonious, and all the sector of rule by law should coordinate mutually. Therefore, the coordination of rule by law is the article's focus, the author hopes this article will be useful to west developmentThe article consists of four parts. Part one is the logic beginning of the article. It dwells on the relationship between the coordination of rule by law and west development, and begins with analyzing the function of coordination of rule by law to demonstrate the virtuously mutual relationship between them.Part two focuses on the coordination between macrocontrbl policy and legislation related to west development How to balance the policy and the legislation is a difficult problem, especially when the former conflicts with the latter. The author thinks that the effective way to solve the above problem is to coordinate the policy and legislation, basing on understanding the jurisprudence relation between them. At the same time, the legislation power of central and local government should be distinguished and coordinated correctly. The west local government should make full use of its own legislation power to embody its characteristic.Part three expounds the coordination of rule by law among all the west areas. Because of the similarity of the different west areas, the west is considered as a whole, and there are many opportunities for the west areas to combine their power and to share with their resources. As far as rule by law is concerned, the west areas should get rid of the selfish local interest to enforce the coordination of rule by law. Being the first stage of rule by law, legislation should be studied first. However, legislation only provides a static law- system, which must depend on law perfonnance and judicature to realize its full function. The author jumps out the thought limit to seek help from judicial refonn when judicial coordination is discussed.Part four probes into the coordination of rule by law between the east and the west. Under the circumstances of west development, the west and the east are not isolated, on the contrary, they have many chances to cooperate and interchange. Rule by law should provide guide and coordination for that. After analyzing the necessity of the coordination between the west and the east, the author demonstrates her viewpoint from three aspects.
