Rational Thinking And The System Of Private Property Rights In The Primary Stage Of Socialism

Based on the basic situation of China at the primary stage of socialism and the reality of modernization, the paper discusses the importance of protecting private property rights constitutionally and legally. It states that during the social economy progression of China, a mature economy circumstance suitable for the private property to attend has been established. The history of socialist development has confirmed that Marxism couldn't be learned simply and doctrinally. We can't deny and limit the private property rights arbitrarily at the socialist situation. The paper thinks that the private property rights are kind of legal rights system including ownership, possession, eminent domain, access and profitability due to these four rights. Private property and the socialist property of the country have the close relationship essentially. The private property is the foundation and source of public property of the country. As a modern country, we can't only limit the private property rights to the criminal law and civil law. We must give the two aspects the same legal prestige in the constitution. The protection of private property rights is the basic premise to realize the political rights and many other kinds of rights of people, and to establish socialist democracy. The paper due to the socialism theory states the source, varied form of the private property rights and the order of realization of rights in details. It also notices that the effect of the development of whole social economy and changes of social ideological form. The goal is to remove the discrimination of private property rights and make it become the most important resource of socialism modernization.
