Conflict Of Rights In A Society Ruled By Law And Co-ordination

This thesis cites phenomena of benefit conflict in law ruled society,. analyzes in details three reasons for the emergence of benefit conflict. That is the contradictory caused by the pattern transference from agriculture civilization to industrial civilization; The citizen's right consciousness is changed from the situation depressed by social value system, to the alertness and declaration of right value consciousness. The tortuous developing history of the law guarantee system of right makes the imperfect Chinese law-ruling system weakens its coordinate ability. Right's ultimate resource is the individual benefit. So the right conflict is the benefit conflict indeed. However the right conflict has its boundary. The right conflict should be the legal and justice conflict between two or among over two main right bodies. This provides theory basis for coordination of right conflict. Thus the right protection rule and the coordinated method is established.
