On The Influence On Chinese Social Security For Public Health Emergencies And Countermeasures

Looking back to Chinese government's rely to the abrupt affair-SARS, the author see that social public order has presented many distinctive characteristics from normal ones. Under the influence of abruptness, publicity, complexity and stage of the abrupt affairs. By reviewing the history of SARS affairs in china, the author see that Chinese government and public security organization adopted a number of affective and valid measures and succeeded replying to some social public order problems that SARS brought, at the same time accumulated numerous precious and valuable experiences on the leading system, the defense and prevention of the mass .As well as some special oraganization's fuction extension. By examing and cheeking the public order reply mechanism under the emergent state of abrupt public hygiene affairs, the author discover four mainly irregularities. On the basis of analysis of present situation, the author put forward some basic and tentative sugguestions. Firstly, permanent emergency in situation should be established under cooperation with health ,epidemic prevention, quarantine ,public security departments in improving public order emergency system of social abrupt public affairs, furthmore, the law main status of the shock forces which participate handling with emergency affairs should be standardized .Thirdly ,the command department and emergency plans should be improved within public security2departments .Besides above all, our country should perfect the social public emergency legal system of the abrupt public hyhiene affairs and define the target principle and stress of the emergency legal system in the field of emergency legal system construction .In regard to eneharting standard of conducting emergency public order problems ,emergency measures should be distinguished from administrative ones, and espeerally, when emergency measure is enforced, numan rights should be fully guarentteed. Sixthly, we should make a full preparations for contingency and the coming abrupt affairs psychologically. We are supposed to intervene crisis initially, and make very effort to maintain society stable .According to the princrple and character ,we should deal with respectively and steadily public order cases and criminal cases caused by public hygiene affairs .In addition ,the difference should be made between administrative assistance and mandatory administrative measures as to avoid abusing administrative mandatory emergency measure and sharpening contradictions .
