The once prevalent Pyramid Schemes in China had severely damaged China's economy and public order. For the reason that Chinese government could not have firm control over the illegal pyramid schemes, in 1998, a prohibition law was even enacted by the Chinese government to entirely ban the operation of direct selling. Now with China's entrance of WTO, direct selling industry is to be re-established. In order to regulate the development of direct selling industry, China is drafting Direct selling Law.Due to the reason that the illegal phenomenon during the development of direct selling primarily arises in the process of illegal multilevel direct selling, the purpose of this article is to discuss how to regulate multilevel direct selling, so as to prohibit the harm of illegal Pyramid Schemes.To solve this issue, firstly, the author studies the respective motives and different processes of multilevel direct selling and pyramid schemes, and investigates the different behaviors of network members in the two selling processes, so as to reveal the composing factors, benefit modes and characteristics in the operation processes of multilevel direct selling and pyramid schemes;Secondly, through the respective features and characteristics of the two selling modes, this article will distinguish multilevel direct selling and pyramid schemes definitely;Finally, based on the division of the two selling modes discussed above, this article establishes a multilevel direct selling regulation and controlling model. According to this controlling model, the author probes into its consequent regulating measures. This is the author's advices and suggestions provided for anti-pyramid scheme legislation.
