Direct marketing as a marketing mode, which influence the development of world retail. Avon entered China in 1990, opened the prelude to the direct selling in China, and other foreign direct selling companies have entered China, at the same time, Chinese direct selling companies also have sprunguped in succession. Due to the imperfect market regulation mechanism, the lack of legal system, the involvement of some criminals and illegal operation of the company, the Chinese government issued a series of documents, but there is no MLM control, the government adopted the means of relatively severe, which prohibit the development of the direct selling industry. However,this does not completely eradicated pyramid selling, especially in recent years MLM company and pyramid selling event, 1040 sunshine project, a family of five, capital operation, etc., emerge in endlessly, to the Chinese people and the national normal law enforcement and bring a lot of inconvenience. In spite of regulations on forbidding pyramid selling and administrative regulations on direct selling, but still not perfect, the thesis of direct selling and pyramid selling, mainly from the following four sections discuss the perfection of legal system of direct selling in China.Firstly, mainly expounds the basic theory of legal system of direct selling. Including the origin of direct selling, direct selling the concept of legal system, legal system of direct sales target, and the principle of direct selling law system.Secondly, the paper introduces the legal system of the main countries and regions outside of direct sales experience and enlightenment. In this part mainly introduces the United States, Britain, Malaysia, Japan, Germany, Taiwan of China and other countries and regions of the direct legal system, from the Angle of the direct selling legislation and a cooling-off period system in detail, and analyses its significance to our country.Thirdly, emphatically analyzes the current situation and existing problems of the legal system of direct selling. This part mainly from the three stages of development ofdirect selling in our country, direct marketing status quo of the legal system and the problems existing in the three aspects. The problems mainly about direct legislation in our country.At last, on how to perfect the legal system of direct selling in China are proposed.On the basis of using the experience of Anglo-American law system and continental law system, combining with the actual situation of our country present stage and national conditions, from the aspects of legislative, judicial, industry association put forward the proposal.
