Civil rights is a related concept, the author tries from the theoretical angle grasp the mutual act between the civil rights and other right( power), from the reason, the term and the path that the civil rights was generated and the constitution confirmation as a result analyze many kinds of compromise factors behind the generation, the confirmation and the existence of the civil rights. .It's formation is connected with specific society. It is a kind of demand of citizen meanwhile it is a kind of society confirmation. Modern civil rights substantially is a kind of statutory right. On the view of the mutual compromise relationship between the citizenship and the national power the author want to see through the ideal and the reality of the civil rights. Nation take the important function on the aspect of making the civil rights confirm by the law and guarantee to realize because of the legal character of the civil rights. Discussing the necessity and the possibility we realize the reason of the compromise. The civil rights gets more perfect in the antinomy between the maintenance of the majority right and the insurance of the minority right. And it is realized by the preference of public benefits and personal benefits. How to guarantee the environmental candor in compromise and how to insure the compromise has the voluntary character as well, how to cultivate the soil that is benefit for the compromise growing in the tradition are all antinomy problems we should resolve. It is objective to treat the realistic condition and the trend of the constitutional citizenship in our country. Have known the lack of the compromise spirit in our country the author proof and lay road to form the institution in theory.
