Complete retirement insurance system is one of the features of a welfare society as well as an integral part of the modern social welfare system. Confronted with the forthcoming of the worldwide aging, all governments has established multi-tired and multi-pillared retirement insurance systems with various forms, including the social retirement insurance system planned and arranged by the government in an all-round way (the national basic sate pension), the supplementary retirement insurance system under which both enterprises and employees contribute (the occupational pension), and the personal saving retirement insurance system (personal pensions). The establishment of the multi-pillared retirement insurance system plays a significant role in the development and improvement of the insurance system for the whole society.What needs to be clarified is that the pensions system is a particular system offering economic interests to specific persons and that the appropriate legal framework is based on the economic features of the pension system. For that consideration, the forepart of the thesis briefly introduces the economic features of the occupational pension insurance so that applicability of the legal construction could be understood.The thesis then makes a macro-analysis of the occupational pension system from the perspectives of system evolution and comparison. The analysis in terms of system evolution can vertically display the changes of policies and the choices of strategies for the relevant systems and be conducive to looking back to the history. The analysis in terms of system comparison can, in a horizontal way, show the comparison among relevant systems and be oriented to the future.Based on the considerations, the thesis first illustrates the general theories and principles of the retirement insurance and the occupation retirement insurance systems and meanwhile introduces the framework of relevant legal policies in China and Great Britain as well. Then it summarizes China's occupational pension system and introduces the use of the trust system for China's occupational pension by comparing with that in Great Britain. In the following section, it analyzes the essential ingredients of the occupational pension system in the framework of trust, which are mainly the legal character, the legal functions and responsibilities of various parties involved in the occupational pension. Finally, the thesis further elaborates on the specific system of the investment and liquidation of the pension fund.
