After China held 2008 Olympic games and 2010 World Exposition successfully, the price in the real estate industry is increasing in speed, especially, in the Beijing and Shanghai. In my opinion, looking at the price in the real estate, although most people have invested in the real estate industry. But there is still not a lot of "bubble" in the real estate industry. The Chinese government legislated a lot of financial policies and regulations to make the macro-control to prevent the financial crisis. The money of making and buying the real estate industry mostly came from the commercial banks. A lots of the real estate industry loan have brought the credit risk to the banks. If these risks blow up, it must destroy the development and stabilization of China's economy badly. How to prevent the credit risk, how to create the new financial technique to separate the credit risk of commercial bank, is the most important thing. The State Council of China has authorized "Real Estate Securitization " recently, that will improve the credit risk of real estate obviously. So, this paper will analyze a subject "The some legal problems of real estate credit risk in the Chinese commercial bank".  The paper consists of four chapters. The first part introduces the newest regulations and policies of real estate of China, and how it works on the commercial bank. The second part is about the reasons and results of the real estate credit risk, it maybe brings the financial risks to the commercial banks of China. In the third part, there is a case about the "credit crisis" to analyse the risk of the commercial banks. To Improve the regulations and protect the credit safety of banks is very important. In this part, I also introduce some kinds of regulations to measure the estate credit risk and how to make the estate credit plan. After that we will use these regulations to improve the management of estate credit risk in Chinese commercial bank. In the last part, according to the "Real Estate Securitization" of commercial bank and the some regulations of China, I will do an analysis and suggestion to improve real estate credit risk management of China commercial bank.
