In china, Estate industry was starting from 1991,It has experienced Breaking ice、push on、development、regulate and control stages, and after the end of housing system at 1998, the estate industry finally has a flyby evolved. In 2003, The “king of land ” was continually happened, and the estate price was pushed to more and more expensive. Then the government was aware of the estate market is really needs to use legal method to regulate. But in fact, the price has a slight cooling trend in 2008, but after 2009, it spawned a huge bubble under the emergency lamp and investment, the price is also arise. The vast majority of specialists believe that the commercial banks is acted as a “pushing hands” role in the estate market, and I agreed it.With the development of China’s real estate market, the legislation of real estate is getting more and more perfect. The main kind of real estate credit varieties in Chinese commercial bank is housing mortgage loan and real estate development loans. Both two kinds of products is facing with corresponding legal risk. Through the examples of housing mortgage loans and real estate development loans, we can see the risks that the bank faced, and i also analyze the causes of the risks, put forward to prevent commercial bank real estate credit legal risks, it must broaden the channel of financing, improving the real estate financing system, at the same time, we must to improving the legal system of real estate, strengthen the national macroeconomic regulation and control ability, Perfect the credit system and raise the cost of credit default, and also to improving the accounting information disclosure system. To guard against the risk, the bank should speed up the innovation of the real estate credit products, Strict scrutiny of the authenticity of the Credit data, Examine associations, guard against risk guarantee falsified, and also Strengthen post-loan management and establish risk prevention and control mechanism.
