| The Internet Bank has brought deep influence to human life, and challenged traditional legal system and idea. The legal question that Internet Bank involves is very abundant and complicated, because of such characteristics as Hi-Tech nature, with no paper at all, instantaneity that this business has, etc… This paper combined practices that domestic and international relevant legislation and domestic banks launched Internet-based banking services, and preliminarily discussed and analyzed the legal questions that the online bank involved. In the first part of this article, through the definition of Internet Bank ,the essential feature ,the advantage and the introduction about the types and the current situation of the development of the online bank, people can form the general understanding about Internet Bank.In the second part, the author recommended the market access and the supervision legal system of the online bank.In the third part, the author explained the legal questions in Internet-based banking services. Firstly, the author summed up the legal relations in Internet-based banking services on the whole, and then began to analyze the concrete legal questions in Internet-based banking services. In the fourth part of the article, the author has analyzed the changes of the current laws that the online bank causes from five respects: economic law,civil and economic law,criminal law , civil procedure and choices of the applicable law in private international law. In the fifth part, through the generalization of the full text, the author gave suggestions on the legislative of the online bank from the macroscopic perspectives. |
