Thinking About The Legal Philosophy Of The Government Building Of The Socialist Rule Of Law

The research about the construction of legal government has important realistic meaning and theory value. In this text, by the method of philosophy, I analyzed the concept of legal government and the practice about "rule of law" in China, suggested that to construct the legal government in China, it should emphasize the strengthening of the limit to the government at the time of keeping its validity. To strengthen the limit to government, it should start from limiting the government's power and guarding the citizen's right. So, Marx's theory about citizen's society gives us a theory form to understand the running of power and the guarding to right.The theory about citizen's society, developed to the theories of relevant citizen's societies in the past, thinks that country and citizen's society not only distinguish each other but also connect each other. This theory has important meaning to direct "rule of law" and the constructing of legal government. The developing history of legal government in western countries and the situation of Chinese citizen society .require China to adopt the road that the government's advancing combines with society's gradual progress to construct the legal government : On the one hand , it should limit the government's power in accordance with the law , insist on administering the state according to law; On the other hand , while improving people's legal consciousness , toexpand its politics participating in, to form the mechanism of checking and balancing to government's power . Rule of law idea indifferent, government's illegal administration existing in a large amount, low degree of citizen politics participating , this is the current situation. According to this, I further propose the concrete measures on the construction of legal government in our country.
