Foreign trade investigation, an operation to safeguard national foreign trade order and fair international trade environments , important means to protect domestic industries, has been paid more and more attention by all WTO members. In the WTO trade system, as a safe valve and an advance party, it's crucial to the stabilization of multilateral trade system to ensure the coherence of all the foreign trade regulations in a country.As a big trade participator, the conflicts of our foreign trade with others increase and the situations of our foreign trade become harsh when trade protectionism become internationally intensified though the economy become globalised. So it's significant for our sustainable and healthy industrial development to strengthen the study of relevant foreign trade investigation regulations such as that of WTO, America, EU and so on.This dissertation not only probes the basis of foreign trade investigation from the angle of politics ,economics and jurisprudence, but also studies systematically the application fields, procedures, means of relief of foreign trade investigation regulation by way of comparative analysis, focusing on the anti-dumping and trade barrier investigation performed in WTO, America, EU and China. In the end ,the author expounds the present situations and existing problems of our foreign trade investigation regulation, proposes to improve it.This dissertation is composed of more than 40,000 words and divided into five sections as follows:Section one General knowledge of foreign trade investigation. Unlike foreign trade relief regulation, foreign trade investigation regulation is such that stipulate the procedure of investigating matters relating to foreign goods trade , technology trade , service trade ,which has its own political, economic and jurisprudent foundation. The author analyses this aspect and summarize the nature and function of foreign trade investigation.Section two Application fields of foreign trade investigation. The author draw the conclusion according to the observing of the legislation of foreign trade investigation of members of WTO as follows: (1) trade barrier; ( 2) anti-dumping , anti-subsidy, safeguards; ( 3 ) matters relating to national security; ( 4) matters relating to human rights and environment protection; ( 5 ) matters relating to property rights protection; ( 6) anti-trust and other anti-unfair-competition; (7) matters relating to principle of reciprocity and others .For the reasons of the frequent use and representative ness of (1) and ( 2 ), the author expounds these two field in detail comparatively.Section three The procedure of foreign trade investigation. It's a procedure including petition, filing, investigating and ruling, relief and so on . The author take the procedures of anti-dumping and trade barrier investigation for example, analyses its procedure by comparing the legislations of WTO> America. EU and China.Section four Means of relief of foreign trade investigation. Similar to others, the means of relief of foreign trade investigation of a member of WTO include judicial examination, DSB of WTO and so on. Also, the author takes anti-dumping investigation for example, focusing on analyzing these methods.Section five Pondering on the improvement of our foreign trade investigation legislation. The author analyses the present situations and existing problems of our foreign trade investigation regulation first, then ponder on the integral construction of our foreign trade regulation. At last, the author give some proposes to our better application of foreign trade investigation.
