| This thesis states the prerequisite of a marriage in the law of marriage and family, and summarizes the category of marriages. The thesis looks back on the prerequisites of a marriage in Ancient China and compares the regulations about the prerequisites of a marriage in China and foreign countries. The Author thinks that the marriages in Ancient China are completely for the purpose of maintaining the patriarchal governance and that the parties have to accept it passively without freedom at all. Based on gradually eliminating the regulations which are not accord with the times and being the little difference, the legal stipulations of the prerequisites of the contemporary marriage trend to the same overall and pay more attention to respect the party individuals. The marriage parties have more autonomy, too. Finally, the author discussed the defects that exist in the stipulations of the prerequisites of a marriage in China, and puts forward suggestions for the perfection of the legislation in the future, that is, expanding the range of the close relatives that forbid to marry and setting up the announcement system of the marriage etc. |
