With the further development of market economy and transition of the social structure, the social poor colony's question is very outstanding. If the basic life of poor colony has not been guaranteed, It is not only government's dereliction of duty in human rights protection of the poor, but also will hamper economy's progress, destroy the stability of the society, can not construct and build up a sustainable development and harmonious society either. And administrative benefit is a very important means of solving the social poor colony's problem. At present, there are less scholars of our country to research administrative benefit, because lack the ripe theoretical direction, there are many questions in the implementation. The research purpose of this paper is mainly through the discussion of basic theories of administrative benefit, I have used the experience and lessons of the administrative benefit system in the foreign developed country, pointed out the weak point of the administrative benefit system in our country, put forward the basic thinking of perfecting the administrative benefit system in our country. This paper has carried on systematic research to the administrative benefit system with historical analysis and comparative analysis. I have explained the origin, the development of administrative benefit with history analysis. Compared the similarities and differences of historical development of the administrative benefit system in the foreign developed country by way of comparative analysis. The paper thinks, it means that the administrative subject give citizens who are under such situations that unemployment, old, disease or losing labor capacity, etc. or other special circumstances some material rights and interests or the rights and interests related to material in accordance with relevant laws and regulations, the rule or the policy. The paper divides into five major parts altogether, probably amount to 50,000 words. One major part expounds the administrative benefit and rule by law. In this part, I have explained the concept of administrative benefit at first, and explained the relation between administrative benefit and interfere administration, administration compensating, social security, social insurance etc. Secondly, I have described the characteristic, the principle, and the meaning of the administrative benefit. While explaining the meaning of the administrative benefit, I have explained emphaticallyadministrative benefit is very important to build the harmonious society at present. Finally, I have described the basic system of administrative benefit, including the target affirmation system, the standard definite system, the fund guarantee system, procedure system, and relief system. Second major part expounds the historical development state of the administrative benefit in the foreign countries and international community, then makes some comparative analysis. I have recommended the historical development orbit of administrative benefit system of Britain, Germany, Sweden, U.S.A. and the international community at first, and then made simple comparative analysis. I have described the state of development that the administrative benefit system of our country and some questions existing mainly in the third majority. I have recommended some practice that administrative benefit nature in history of our country at first. Secondly, I have expounded the fact of the administrative benefit in our country in the current situation. Then I pointed out the weak point of the administrative benefit system in our country. The greater fourth part expounds the perfection of the administrative benefit system mainly. I have expounded the basic principle of the administrative benefit system firstly. Then I put forward the perfecting basic thinking of the administrative benefit system. The fifth major part concludes the paper, I have made simple summary to the whole paper. The main innovation of this paper includes two respects. Firstly, I have described the basic system of administrative benefit.
