Today, education plays an important role in economy and cultural life, even in political life all over the world .To receive education has become an inevitable choice for members of modern society to survival. The right to receive education, as a fundamental human right, has been claimed by international human rights law and domestic law. The majority of the world's countries have affirmed this right in the constitution and common laws. The same is true in China. It is a constitutional right to receive education in china, and the government has passed many laws to protect the right to receive education. But in reality, it is not optimistic. There are many unequal situations in education. Especially during the vast rural areas, the situation is even worse.In the background of the third technological revolution and knowledge-based economy, it means a lot more than before to receive proper education. Education is important not only to citizens themselves, but also to the nation. The thesis studies the right to receive education, and has a great interest in the rural areas.This thesis is divided into four parts:The first part mainly presents the basic theory about the right to receive education. Firstly, take a back-look to the right to receive education. It has gone through three stages of changes: obligation ; obligations and rights ;human right. Three are four theories about the nature of the right. I think that they are all reasonable. Next, sort out the contents of the right to receive education. It includes the right of access to education, education conditions, and the success of the right to education. Finally, put forward the concept of the right to education.The second part is focus on the value of the right to receive education. This thesis mainly concerned about equality and efficiency. Equality is the fundamental value, but it doesn't mean that we can pay little attention to efficiency. Equal right to education includes equal right and equal opportunities and equal results. In reality, there are three practice models to realize equality: universal education model, popular education model and education of all. The third part of the thesis is the protection of the right to receive education from all angles, the legislative, administrative, judicial, basic policy to build a tight security system. First it is the introduction of Legislative status, including domestic and international law. And the following is the analysis of the shortcomings of Chinese education legislation. Its proposal is to complete the legislation as soon as possible to improve education; Then from the view of government, it is very crucial to improve the administrative system .We have to establish an administrative appeals system and administrative reconsideration system. And the following is about the justice system construction to protect the right to receive education. At last, based on the foregoing analysis, review our country's fundamental policy, which has great means to the right to receive education.The last part is the research carried out in rural areas. Across vast rural areas in china, there is a serious shortage of educational funds. And the worst thing is that there exists a huge gap between urban and rural areas. With the negative impact of industrialization of education, the situation is getting worse. There are two special groups, children of farm workers and women in rural areas, whose right to receive education attract more attention in our society. After the discussion, we try to find some solutions to help them realize their rights to receive education.
