Study On Legal Issue Of Crew Social Security Of China

21st century is the century of ocean and blue civilization. The marine economy develops in prosperity. It is urgent to constitute a specific social security law to protect the crew's legitimate rights and interests for their great contribution to the fast development of the marine economy. But due to several reasons, we don't have any rule about crew's social security in our country's social security legislation. In practice, the legal relationship of crew is mostly adjusted by the law made for the men who work on the land, which results to the fact that the right of the crew cannot be protected effectively. Crew is a special group in the society, and this profession has certain risks. They work in the ship and live on the sea all year round. The circumstance that they work in is very bad, so they need a special law to protect their rights, which becomes a key element of the development of marine economy. Crew is the soul and core of the marine industry, also the main force to push the development of marine industry. So the protect ion of the legitimate rights and interests of the crew meets the aim of Chinese government to compose a harmonious society. Under this circumstance, the concern about the crew's legitimate rights and interests and the construction of harmonious marine platform are especially important to consummate the crew's social security system.This thesis is divided into six chapters. The first chapter introduces the concept and professional characteristic of crew; The second chapter elaborates the social security, the concept of social security law, and analyzes the enlightenment that the function of social security law to safeguard the crew's rights and interests; The third chapter focuses on the crew social security legislation's international condition, which elaborates the evolution of crew social security legal rule made by the International Labor Organization, as well as related legislation in other countries; The fourth chapter has analyzed the realistic problems that Chinese crews face on the base of the introduction of the special role played by the crews, which leads to the conclusion that the establishment of the crew social security law is necessary; The fifth chapter analyses the laws about the crew's social security made by the International Labor Organization and other countries and the international convention, then comes to the conclusion that crew's social security law should be constructed from three aspects: the crew social insurance, social relief and social welfare, combining with the present situation of Chinese crew social security legislation; The sixth chapter is mainly about the thoughts how to consummate the crew social security.
