The Historical Debt Problems Of China's Endowment Insurance

This dissertation mainly discusses under the law of social security , the system of our country's old-age insurance when the new public was founded, specially involving the labor insurance fund that was withdrawed by the enterprise and the national unification for collection and filling prescriptions. As the reform and open policy started to implement, the system has changed into the union of the social overall plan and individual account. Because the new pattern lies on the fact that "presently taking and specie payment" and there is no accumulation of fund, it has formed the historical debt counted by millions of large amount which should be paid through any way in due time. From the second chapter, this dissertation elaborates on the following legal matters under the law of social security through three chapters: the nature of the historical debt and the government's responsibility; the legal consequences which the historical debt caused in due time and how to melt it. This dissertation is expected to find out the effective ways under the law of social security that can solve our country's historical debt of the old-age insurance system has caused in legal scientific domain. It appeals that the central finance should decisively undertake the responsibility for the payment and extricate the financial burden of the local government in filling the history debt. So it can relieve the people's caring for the aged. Then the government and the people' attention will be shifted to concentrate more on economical development and social stability.
