Study Of International Project Contracting, Legal System

In the multilateral negotiation process of China's entry into WTO, China made the concession commitment in the field of Construction and related services. Since joining of WTO, China has been liquidating, revising and constituting laws and regulations concerning construction and foreign economic cooperation to enhance and improve management if International Contracting. With the strategy of "Introducing to the World" and "Going out" coming to a new stage, new breakthroughs has been achieved in International Contracting and with the continuous expansion and opening up of domestic construction market, to research on the concerned international economic law so as to promote the legislation of concerning laws, establish of legal risk guarding mechanism of contractors, promote the theoretical level of law practices and ability of implementation and thus speed up the development of international contracting in China.The thesis is separated in three parts. The methods of historical analysis, comparative analysis and eventual research were adopted to conclude concerning laws and regulations of international contracting, comb international treaty, convention and legal system of international contracting in other countries. Through comparison of current domestic legal system on international contracting with other countries, the author got valuable inspiration on the legal system of international contracting in China. At last, the author gave some suggestions on the legislation system of international contracting in China.Part one Laws and regulations of International contracting. Three aspects were concluded in this thesis: I International contracting and concerning legal system; II local laws and regulations II International treaty and conventions. The author hereby summarized concerning knowledge of international contracting concluded relevant concepts, which laid foundation for further research on the legal system of international contracting.
