As the most important security device in modern civil law countries since Roman Law Legal Family has been located, mortgages always have been called "king of the security " and therefore the achivement of the mortgage right holds a important position in mortgage systems. However, in China, the current study on the achievement of the mortgage right has not been mature enough, and also, the existing legislation and judicial practice also exist many problems, this phenomenon chokes off mortgages's smoothly achieving.This paper will choice the achievement of the mortgage right to study, according to China's mortgages achievement basic law, analyze of existing legal system's errors.
