Study Of A Number Of Issues Of Land Acquisition And Compensation System

The administrative act, that the country takes back the land of collective ownership to the state according to the law for the public interest, is called land expropriation. Land expropriation relates to the interest between the public and the private. Land is the most important living and production base, so the rights about land should be protected enough. We ought to pay the enough, fair and rational compensation to the private because of the public interest.In our country, the contradiction between the public interest and the private interest is very clear in the land expropriation and land expropriation compensation, which due to the Chinese tradition of center of obligation. This paper will research the essentials of land expropriation and the principles of the compensation from the angle of constitutionalism. The further research will give some constructive suggestion about the legal system of land expropriation, such as the scope, standard, method, the procedure and the relief of compensation. I wish the research will benefit to the legal system reconstruction.
