On The Traditional Foundation Of Mediation System In China

Intercession system has a long history in our country and is a legal system with Chinese characteristics. It is deeply rooted in the traditional Chinese culture, and is the main means of settling dissention among the folks and in the court. By illustrating the root of traditional intercession system, this dissertation analyzes the economic, cultural and ethic causes, and the deeper historical causes for the formation of the system, such as social value orientation. It also supports that the concept of harmony has been deeply rooted in the Chinese minds. In the context of market economy, conflict in benefits, people's relationship and value become multiple, and intercession became a native medicine for these diseases. In view of the status quo, this dissertation argues that we should rationally ponder and take traditional harmony as reference, making full use of native resources, adapt and perfect the intercession system.
