The theory of Mao's constitutional government is the very important part of Mao Zedong thoughts. It's significant for construction of Chinese constitutional government of new times to study and discuss the development and transition of Mao's constitution thoughts. Early before establishment of New-China, Mao Zedong has legislated The Common Guiding Principle with the other democratic parties. Especially in 1954, he has presided to draft out the first socialistic Constitution of China which is the base of the legal system construction of New-China.The Constitution of 1954 pumped a great deal of painstaking efforts of Mao Zedong, and is the centralized embodiment of the Constitutional Government Theory of Mao. In this Constitution, many of his Constitutionalism Principle and Constitutional thoughts is adopted by The Constitution of 1982, such as the science principle, the dumb millions' s sovereignty principle and the principle of combination of principled and flexibility. Unluckily, after 1957 Mao Zedong's whole thoughts of law slide into law nihilism. He abandoned the thoughts of rule of law slowly and finally incline to rule by people. Consequently, it result in stop of the whole Chinese construction of law system. That is a big tragedy to Constitutional Government of China.This paper attempt to give some references and cautions for construction of Chinese Constitutional Government through my study on the development process of Mao Zedong's Constitutional thoughts.
