Relative Illitigation System (RIS) is an important part of Criminal Procedural System. It has drawn some reasonable kernel from citigation cheapism and embodies some unlimited judgements of public procuratorates, which is of vital importance in the value of law. The new Criminal Procedural law has conformed RIS, but its value has not been fully open out on account of oversight of system itself and deviation in specific manipulation. Therefore, it is necessary to deeply study its application in practice and problems in RIS, and it is expected to assist legislative improvement and judicial practice. The right of relative illitgation is an important part of procuratorial supervision. Correctly pertorming the right is able to fully embody legislative spirit and lenient and severe criminal policy, to effectively divide and demoralize offenders and educate, persuade, move and save, the person who take false step in life, to economize judicial resource and reduce the accumulating lawsuits. In order to bring good social and legou influence.Nowadays it has aroused practicalists and academics great concern as to how to apply this system into judicial practice. From the overall view, discussion on RIS in this article not only offers a set of complete specific procedural system, but also macroscopically explores an entire thinking and masters the system wholly in order to enrich its content and improve the procedure and realize its value.
