| Marx's legal thoughts was formed when he constructed his theory about the problem of modern society. In the fact, during the dialectically developing process which is from positive to negative and negative again. Legal philosophy is not only as the beginning of Marx's theories, but also as the consistent core factor of Marx's theories. On one hand, Marx pointed out the end of the human, the communist society,in the grand theme of criticizing civil society,on the other hand since starting Marx gave law dual role as reflector and giver,and clarified the dialectically movement of law based on its contradiction which do good to the development of modern society.Through the logical development,Marx's theories and law have become a self-harmony overall, which embodied the dialectical approach of historical materialism to solve society problems and was for reconciling the human society.In the introduction,this paper manages to explain the real historical and cultural background of which Marx's theories has been developing out, to show the reasons that his theories dveloped.That is the problem of the intrinsic tension in Modern Society or the problem of modernity. This is the very starting point,from which this paper tries to explore Marx's social and legal thoughts.In the second part,this paper traces back to the theories of civil society before Marx,which is the historical source of Marx's civil society theory.Based on this,the author further explores Marx's optimistic expectation on civil society and his new critical rationalist legal thoughts in his early ages and points out that Marx took law as the driving force to ensure freedom in society even at that time.In the third part,the paper probes the development of Marx's theory in the transition period.For the frustration encountered in the reality,Marx began to reflect.By criticizing the legal philosophy theory of Hegel,who was the most successful German philosopher,disclosing... |
