Choose The Path Of Government Information Disclosure Legislation

It' s an irresistible general trend for the governments of all levels to make their information public. At present, to properly institutionalize the legislation of governments' information publication is an urgent need for the nation' s democracy and the legal system. Therefore, the problem the governments have faced in the first place is to choose, according to the current situation in China and the beneficial experience from foreign countries, a legislative approach which enables the information publication not only to meet the requirement for the economic development but also to facilitate the construction of the nation' s democracy and the legal system.By researching into the controversies on legislative approaches offered by Chinese scholars ,the legislation modes of information transparency chosen by some foreign governments as well as the current situation in China, this article suggests that our governments of all levels should take a bottom-up and step - by - step approach to legislate their information publication. First , local governments lay down rules or regulations to put them into practice; second, it' s up to the State Council to formulate " Regulations on Governments ' information Publication". Last, as the time is ripe, the National People' s Congress and its standing committee begin to enact " law on Governments' information Publication" , This paper also points out, in the view of Chinese current situation that the first thing on the information publication for local governments who take the initiative on the lawmaking is to create a legislative environment so as to accelerate the establishment of the correspondent legal frame which is supposed to be...
