On The Uniformity Of Administrative Law Enforcement

After the basic strategy of ruling the country by law settled, China speeds up legal system construction. After years of unremitting efforts, the relevant laws of all trades and professions appeared one after another. Now the socialist legal system with Chinese characteristics has been basically established, and the problem of having law to go by has been basically solved. The key issue is how to ensure the correctly implementation of laws, and administrative enforcement is a crucial to the law implementation. According to statistics, 80% of law enforcement depends on the administrative offices. It can be said that without strong administrative enforcement, all the efforts of legislation will become useless.With entering WTO and strengthening socialist legal system construction constantly, China's administration completes a transition from "management" to "law enforcement", and makes constantly improvement in the manner of law enforcement. It is undeniable that there are still many problems in the administrative enforcement currently: the concept of law enforcement is rigid and backward, the main subject of law enforcement is multi-system and intersecting, the foundation of law enforcement is deficient and conflict, the functions of law enforcement is absent and offside, the methods of law enforcement is opaque and not standardized, and the supervision of law enforcement is not so complete and so on. However, in my opinion, all these issues boil down to one point, that is "unity". Disunity influences work of the administration and law enforcement tremendously. To seize this key problem and resolve it is an only way to strengthen and improve the administrative law enforcement. Any other ways and means to evade uniformity could at most get superficial and partial or incomplete results.Why should we persist in the unity of administrative enforcement? First, the focus of unity is the precise requirement of the unified fundamental legal principle of WTO rules to the administrative enforcement. Secondly, the focus of unity is the precise requirement of the unified fundamental principle of socialist legal system to the administrative enforcement. The administrative enforcement work more and more directly related to the survival and development of the administrative offices, the process of China's socialist legal construction, and to be able to achieve the goal ofbuilding a government under the rule of law.How can we achieve a unified administrative enforcement work? We must adapt to the new situation, in accordance with the requirements of the unity of administrative enforcement, from the concept, the structure, the foundation, the functions, the methods, and the supervision of administrative enforcement to regulate and unified the administrative enforcement work comprehensively, systematically and thoroughly. In every specific area of administrative enforcement, it is necessary to identify the problems that exist in reality firstly. It is useful to propose appropriate measures to be studied and solved. Through the concept, foundation, structure, functions, methods and supervision of administrative enforcement, from concept to the system, from external to internal, linked together, to solve the problems that exist in administrative enforcement comprehensively. In order to strengthen China's administrative legal system, we must strive to improve the quality and level of administrative enforcement and to ensure that administrative enforcement is strict, fair and civilized.Since administrative enforcement deals with a broad scope, including public security administrative enforcement, customs administrative enforcement, industrial and commercial administrative enforcement, tax administrative enforcement, and city government administrative enforcement and other administrative departments and offices. In every department, there are still several more specific categories of administrative enforcement. For example, public security administrative enforcement can also be divided into public security control administrative enforcement, traffic control administrative enforcement, fire control administrative enforcement and frontier inspection administrative enforcement and so on. In order to explain the problem more specifically and clearly, in this text I will take frontier inspection administrative enforcement for example.
