Comprehensive administrative law enforcement is an important part of deepening China's administrative system,one of the main carriers of building a government ruled by law,based on China's national conditions and practical needs of a law enforcement system innovation.In the past practice and exploration in various parts of the country,due to the imperfection of the legal system,administrative system,law enforcement concept,law enforcement and supervision,the development of market supervision and management of comprehensive administrative law enforcement has exposed many practical problems,affecting the effect of reform.At present,the opening of a new round of institutional reform has brought the comprehensive administrative law enforcement in the field of market supervision and management into a new historical period.The new situation,such as the large-scale increase of functions,the large-scale expansion of the regulatory field,the complexity and diversification of the market subjects,has also made the challenges to supervision and law enforcement more and more severe.Under the background of institutional reform,how to better construct a scientific and efficient comprehensive administrative law enforcement system of modern market supervision and management has important theoretical research value and practical significance.Based on the reality,starting from the study of the development of comprehensive administrative law enforcement and the exploration of reform practice carried out throughout the country,and combining with the reform process of comprehensive administrative law enforcement of market supervision and management at the present stage,this paper points out the main problems and drawbacks existing in the comprehensive administrative law enforcement of market supervision and management,namely,conflict of legal basis and administrative recovery.There are gaps,unequal powers and responsibilities of law enforcement,imperfect power supervision and so on.In view of these problems,this paper analyses and discusses the legal theoretical basis of comprehensive administrative law enforcement of market supervision and management.Guided by the theoretical basis of fairness and efficiency,power and responsibility,and focusing on the different situations and characteristics of the transitional period of reform,the initial stage of completion of reform and the period of full realization of reform,and according to the principles of administration by law,unity of powers and responsibilities,and openness and fairness of administrative rule of law,this paper puts forward the construction of legal system,establishment of institutions,supervision of powers,etc.In the aspect of market supervision,comprehensive administrative law enforcement is perfected,so as to provide some reference for building a unified,standardized,authoritative and efficient comprehensive administrative law enforcement system of market supervision and management in China.
