The rural economics registered rapid development in more than20 years of reform and opening up, but the gap between urban and ruralareas has become increasingiy serious. Under such circumstances, thecentral authorities have introduced a policy of building new ruralareas, strengthen the infrastructure construction in rural areas isan important part of it. Rural infrastructure is the material andsocial conditions which must be used in the entire process ofagricultural production. They are materials used in the workforce,the total factor productivity of labor, etc. Based on the content,they can be divided into two categories: material infrastructure andsocial infrastructure. With the general public goods characteristicsof rural infrastructure, external, natura 1 monopoly characteristicsand investment funds aggregation, infrastructure investment andmanagement of agricultural goods is diffident from the private goods.Rural development, especially the supply of infrastructure, couldnot keep up with the development of the economy, with the simul taneousdevelopment of the rural economy, very incompatible with thedevelopment of society as a whole; a greater contrast with thedevelopment of urban communities is especially evident. The lack ofstable infrastructure investment, planning and inadequate supply ofresponsibilities are the main outstanding issues. One importantreason is the deficiencies of existing system. Rural Infrastructureis the capital of our country, the material basis for sustainabledevelopment in the agricultural economy, the prerequisite for thedevelopment of the rural economy. The low supply in ruralinfrastructure had seriously impeded the development of agriculture,farmers' income, and the achievement of well-off society. Ruralinfrastructure has the general publ ic goods characteristics, so, theintervention of government is necessary. Economic law is a act aboutstate management of social economic relations which plays an important role in strengthening the building of rural infrastructureThis article will analysis the rural infrastructure situation andsystem shortcomings from the view of Economic law, then, the articlewill introduce the experiences of abroad. Based on those experiences,the article will establish a new rural construction system. The fulltext is divided into five parts:The opening chapter is the introduction, a brief description ofthe significance of writing. The first part describes the conceptof rural infrastructure, features. This paper will be identified thetarget as material infrastructure, not related to the socialinfrastructure, but also distinguishes "public utility"formulations; based on the theory of public goods, the second partwill expound the affection of the government to correct marketfailures in the area of public goods, then reached on the conclusionthat economic law plays an important role in the process of ruralinfrastructure construction. The third part analysis the inadequateof China's rural infrastructure, summarized as inadequate supply andthe supply structure is irrational two respects. I think that thesituation of rural infrastructure has caused the restrictive effectson the income of the farmers and rural economic development. And fromthe main body legal system, the planning legal system and thefinancial legal system analysis the reasons for the backward ofconstruction of rural infrastructure. On the respect of main bodylegal system, we will discuss two main roles, the government and themarkets, both superiority and the lack of run for their respectiveareas. For explaining the problems that exist in the currentinfrastructure planning; I will take two counties in Guizhou andShaanxi province as examples. There are two major problems in thefunding legal system, the main body and the sources of financing.The fourth part will introduce the New Vill age Movement in South Koreaand the experiences of United States in development of western UnitedStates. The reconstruction of the system of rural infrastructurc is the fifth part. I think the basic values of economic law, fairnessand efficiency, should be the principle for reconstruction.Construction of concrete institution should conclude the improvingmacro-control system, the establishment of scientific planningsystem, establishing a diversified supply system three major areas.The macro-control system mainly deals with the reiationship of thegovernment and the market. Neither the market' s regulation nor thegovernment' s intervention is a panacea, they all have inherent flawsand failures. The key is to find the best combination of thegovernment regulation and the market mechanism. I think that shouldeventually establish a system market-oriented, governmentreasonably intervention in the construction of rural infrastructure.
