Recently, the quality problem of residential building has become a topic of debate amongst various people in our country. The residential buildings with defects or with poor quality had done or will do great harm to people; these quality problems of residential building even hinder the development of the residential building industry. The laws and regulations which regulate the quality problem of residential are deficient in our country. The most important task at the moment is making a basic law to regulate the quality of residential building. The paper has researched this important topic and findings are as follows:Part one mainly says the concept of residential building, quality and the quality of residential building, then analyses the current status of the quality of residential building in China and the possible major causes. There are three major causes, such as lacking of consciousness of law, lacking of a perfect legal system, no basic law to regulate quality of the residential building, and some problems in implementing the laws and regulations.Pate two mainly says the basis of the quality of residential building from jurisprudential. The legislation which the quality of residential building is originates in the demand of human safety and health, and the sustained development of residential building industry; also it's the demand of the justice value of the law. Safety right and health right are both important right of human beings, safety right is the basis of other rights, and health right is a major content of human right. The principle of sustained development is the important principle of our country's economical building. The values of fair and justice are also the two significant values of residential building quality law. Through setting up the obligations of the businessmen of develop and build residential building, the residential building quality law can establish a fair relation between the producer and the consumer. The law safeguards the right of residential building consumer which embodies the justice value of the law. And then the paper compared the residential building quality law and the product quality law. The paper points out that there are some different between the two laws. It's necessary to make residential building quality law. Part three, the author has introduced the presentations of the laws and regulations on residential building quality abroad. By comparing the basic regulations and administrative organizations in England, France and Japan, it points out the disadvantages exiting in Chinese residential building quality regulation recently. It is necessary to make a residential building quality law in china.Part four, it discusses in two aspects. Firstly, it puts forward the premise of residential building law. The author point out it should has the characteristics of market regulates law and the basic principles of the law. The law has two major principles, protecting both right of the producer and the consumer and sustained development principle. Secondly, the system of residential building law is composed of responsibility of residential building quality system and residential building quality management system.
