On Perfection Of Administrative Confirmation System

The Administrative Affirmation is an important means of State administration, as well as an important system of administrative law studies. Administrative affirmation is good for executive agencies to conduct scientific management and it can provide an objective basis for court trials, also to prevent and resolve disputes and protect the legitimate rights and interests of individuals and organizations. The administrative affirmation act is a specific administrative behavior. It is widely believed to be paralleled to administrative permission and administrative penalty, but compared with the two systems, the recognition of administrative affirmation system is still quite weak, either from the theoretical foundations or the system design needs to be further explored. With the current enactment of individual administrative bills such as the "Law on Administrative Permission", the voice of regulating the administrative affirmation acts has gradually highlighted. It is necessary for administrative affirmation acts of systematic study to be confirmed by the academic and practical fields as the specific administrative acts. This paper attempts to sort out the concepts, forms, characteristics and other theoretical problems on the basis of academic research results and existing laws and regulations to explore the developing trend. At the same time, I give some corresponding proposals to solve the problems in practice, with a view to improving the administrative affirmation system and promoting the process of administrative law.
